Welcome to the Batteroo.com website (the "BatterooSite"), a website owned and operated by Batteroo, Inc.("Batteroo").

The terms and conditions stated below, along with the policies and guidelines located throughout the Batteroo Site (collectively herein the "Terms of Use") identify what you, as a user of the Batteroo.com Site ("you" or "User") can expect from Batteroo, Inc., and what Batteroo in turn expects from Users. By visiting any area on the Batteroo.com Site, creating an account, or making a purchase via the Site, a User is deemed to have accepted the Terms of Use. If you do not agree to be bound by these Terms of Use and to follow all applicable laws, you should leave the Batteroo.com Site immediately.

I. LICENSES AND RESTRICTIONS
Bateroo grants the User a limited, nonexclusive, revocable license to access and make personal, non-commercial use (unless User has a business relationship with Batteroo) of the contents of the Batteroo.com Site, which includes Batteroo. Batteroo further grants the User a limited, nonexclusive and revocable right to create a hyperlink to the Batteroo.com Site so long as the link does not portray Batteroo, its subsidiaries, and affiliates, or their respective products or services in a false, misleading, derogatory, or otherwise offensive matter.

The foregoing licenses do not include any rights to:

  • modify, download (other than page caching, reproduce, copy, or resell the Batteroo.com Site, the Content or any portion or derivative thereof;
  • commercially use the Batteroo.com Site, the Content or any portion derivative thereof (unless User has a business relationship with Batteroo)
  • copy or download any User's account or profile information for the benefit of any third party;
  • use any robot, spider, data miner, crawler, scraper or other automated means to access or index the Batteroo.com Site or its systems, the Content or any portion or derivative thereof for any purpose;
  • interfere or attempt to interfere with the proper working of the Batteroo.com
  • bypass any measures used by Batteroo.com to prevent or restrict access to any portion of the Site, the Content or any portion or derivative thereof;
  • frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Batteroo;
  • use Batteroo name, trademarks, services marks or logos in any meta tags or any other "hidden text" or
  • compile, repackage, disseminate or otherwise use data extracted from the Batteroo.com Site.

The foregoing are expressly prohibited; the right to do any of the foregoing shall require Batteroo’s express written consent (which may include a written agreement signed by an authorized representative of Batteroo). Any unauthorized use of the Batteroo.com Site, the Content or any portion or derivative thereof shall terminate any license or permission granted by Batteroo.

II. TRADEMARKS
Batteroo, or affiliates, or third parties from whom Batteroo has permission, own the trademarks or service marks that are used on the Batteroo.com Site. All rights are reserved. These and other graphics, logos, service marks, trademarks and trade dress of Batterooand its licensors may not be used without prior written consent. Without limiting the foregoing, no Batteroo trademark or trade dress may be used in connection with any product or service that is not Batteroo’s, in any manner that is likely to cause confusion among Users, or in any manner that disparages or discredits Batteroo.

III. CONTENT
Proprietary Rights
User acknowledges that the Batteroo.com Site contains Content, that is protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is or may be copyrighted as a collective work under the U.S. copyright laws, and Batteroo.com owns a copyright in the selection, coordination, arrangement, and enhancement of such Content on the Batteroo.com Site. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any such Content, in whole or in part. If no specific restrictions are displayed, Users may make copies of select portions of the Content, provided that the copies are made only for User's personal use and that User maintains any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see, e.g., 17 U.S.C. Section 107), User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other property right. In addition to the foregoing, use of any software Content shall be governed by these terms and any software license agreement accompanying such software.

IV. PRICES
The price for an item on the Batteroo.com Site may differ from the price shown in a User's shopping cart and it is possible that such price may increase or decrease between the time the item is placed in a shopping cart and the time that the purchase is actually made. On rare occasions, an item may be priced incorrectly on the Batteroo.com Site. If the price for the item on the Batteroo.com Site is incorrect and is actually higher than the price provided at the time of purchase, then, at the sole discretion of Batteroo, Batteroo may either (i) contact the User for instructions before shipping the item or charging the User for such item; (ii) cancel the order for such item and notify the User of such cancellation; or (iii) ship the item at the incorrect price to the benefit of the User. Please note that this policy regarding prices applies only to items sold and shipped by Batteroo.

VI. RISK OF LOSS
The risk of loss and title for all items purchased via the Batteroo.com Site pass to the User upon delivery of the item to the carrier.

VII. AGE OF USERS
We do not knowingly collect or solicit personal information from children under the age of 13 or knowingly allow such persons to register for an online account or to post personal information on our websites. Should we learn that someone under the age of 13 has provided any personal information to or on any of the Batteroo.com websites, we will remove that information as soon as possible.

IX. TERMINATION OF USAGE
Batteroo may issue a warning, temporarily suspend, indefinitely suspend or terminate any User's right to use or access all or any part of the Batteroo.com Site including any account thereon, without notice, for any reason in Batteroo’s sole discretion, including without limitation violation of the Terms of Use, Batteroo’s belief that

such access would violate any applicable law or would be harmful to the interests of, or potentially cause financial loss or legal liability to, Batteroo.

X. INDEMNITY
User agrees to indemnify and hold Batteroo harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of such User's use of the Batteroo.com Site, the Batteroo.com Services, breach of the Terms of Use or User's violation of any law or the rights of a third party.

XI. PASSWORD AND ACCOUNT SECURITY
Every User that has an account on the Batteroo.com Site is responsible for (i) keeping his or her account password confidential and secured, (ii) avoiding unauthorized access to such User's computer; and (iii) keeping the e-mail address associated with that account current

User accepts full responsibility for all activities that occur within such User's Batteroo.com account or shopping cart.

XIII. NOTICES
User consents to receive electronic communications from Batteroo&, whether addressed to the e-mail address associated with such User's Batteroo account or posted on the Batteroo.com Site. User acknowledges and agrees that any communication via e-mail or by postings on this Batteroo.com Site satisfies any legal requirement that such communications be made in writing.

XIV. DISCLAIMERS AND LIMITATION OF LIABILITY
Batteroo is not responsible for and makes no warranties, express or implied, as to any Content appearing on or accessed through the Site posted on the Batteroo.com Site or through the Batteroo.com Services. Content does not necessarily reflect the opinions or policies of Batteroo. Batteroo is not responsible for the content, accuracy or opinions expressed of any third party websites linked on the Batteroo.com website, and such websites are not necessarily investigated, monitored or checked for accuracy or completeness Batteroo. Inclusion of any linked website on the Batteroo.com site does not imply approval or endorsement of the linked website. When you access these third party sites, you do so at your own risk. Batteroo assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User communication. Batteroo is not responsible for any problems or technical malfunction of the Batteroowebsite, or any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or players due to technical problems or traffic congestion on the Internet or combination thereof, including any injury or damage to Users or to any person's computer related to or resulting from participation or downloading materials in connection with the BatterooSite or Services. Under no circumstances shall Batteroo be responsible for any loss or damage, resulting from use of the Batteroo.com Site Services.

The Batteroo.com is provided on an "as is" and "as available" basis. To the fullest extent permissible by applicable law, Batteroo.com disclaims all implied warranties, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Without limiting the foregoing,Batteroo.com neither makes any representation or warranty of any kind, express or implied: (i) as to the operation of the Batteroo.com Site, or the information, Content; (ii) as to the accuracy, reliability, or currency of any information, Content on Batteroo.com (iv) that the Batteroo.com site is free of viruses, scripts, trojan horses, worms or other harmful components.

Batteroo.com does not guarantee the continuous, uninterrupted or secure access to Site. The operation of the  Site  may be interfered with by numerous factors outside the control of Batteroo.Under no circumstances Batteroo be liable for any damages that result from the use of or inability to use the Site. Batteroo will not be liable for any indirect, incidental, special or consequential damages arising from the use of the Site, or the purchase or download of any Content, or product therefrom, even if Batteroo has been advised of the possibility of such damages.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to a User, some or all of the above disclaimers, exclusions, or limitations may not apply to such User, and such User may have additional rights.

XV. SEVERABILITY
The provisions of these Terms of Use are intended to be severable. If for any reason any provision of these Terms of Use shall be held invalid or unenforceable in whole or in part in any applicable jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction. The failure of Batteroo to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision.

XVI. APPLICABLE LAW; JURISDICTION
TheBatteroo.com Site is created and controlled by Batteroo in the State of California. The laws of the State of California will govern the Terms of Use, without giving effect to any principles of conflicts of laws.

Each User agrees to submit to the nonexclusive personal jurisdiction of the courts located within CA, and waives any objection to the laying of venue of any litigation in said courts.

XVII. DISPUTE RESOLUTION
Any claim or controversy at law or equity that arises out of the Terms of Use, or the Batteroo.com Site (each a "Claim"), shall be resolved through binding arbitration conducted by telephone, online or based solely upon written submissions where no in-person appearance is required. In such cases, the arbitration shall be administered by the American Arbitration Association under its Commercial Arbitration Rules (including without limitation the Supplementary Procedures for Consumer-Related Disputes, if applicable), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Alternatively, at Batteroo’ssole option, a Claim (including Claims for injunctive or other equitable relief) may be adjudicated by a court of competent jurisdiction located in Santa Clara County, California.

Any Claim shall be arbitrated or litigated, as the case may be, on an individual basis and shall not be consolidated with any Claim of any other party whether through class action proceedings, class arbitration proceedings or otherwise.

Each of the parties hereby knowingly, voluntarily and intentionally waives any right it may have to a trial by jury in respect of any litigation (including but not limited to any claims, counterclaims, cross-claims, or third party claims) arising out of, under or in connection with these Terms of Use. Further, each party hereto certifies that no representative or agent of either party has represented, expressly or otherwise, that such party would not in the event of such litigation, seek to enforce this waiver of right to jury trial provision. Each of the

parties acknowledges that this section is a material inducement for the other party entering into these Terms of Use.

XVIII. DIGITAL MILLENNIUM COPYRIGHT ACT.
The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by Batteroo, infringe your copyright, you (or your agent) may send Batteroo a notice requesting that the material be removed or access to it blocked. The notice must include the following information (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed (or if multiple copyrighted works located on this website are covered by a single notification, a representative list of such works); (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Batteroo to locate the material on the Site; (d) the name, address, telephone number and e-mail address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send Batteroo a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA; see http://www.loc.gov/copyright for details.. Also, be aware that there can be penalties for false claims under the DMCA.

XX. ACKNOWLEDGMENT
The Terms of Use, including all documents referenced herein, represents the entire understanding between User and Batteroo regarding User's relationship with Batteroo and supersedes any prior statements or representations. Headings used in the Terms of Use are for reference only and shall not affect the meaning of any terms. "Including" means "including, without limitation."

XXI. MODIFICATION
Batteroo Reserves the right to make changes to the Batteroo.com Site, posted policies and Terms of Use at any time without notice or liability. These terms were last revised on Oct 30, 2015.

XXII. Promotional codes

Promotional codes are limited in nature and may expire or discontinue with or without notice.  Promotional codes are void where prohibited by law.  Promotional codes may not be copied, sold, or otherwise offered.  They are not redeemable for cash and are subject to cancellation or change at any time for any reason.

XXIII.Custom Charges

customers outside the United States will be responsible for paying any associated customs fees or taxes that may be required by their respective countries. Batteroo is not responsible or liable for any such customs fees or taxes. This includes, but is not limited to, customers in Belgium, Canada, Germany, Finland, Portugal, Switzerland, UK, Netherlands and Sweden.

 
 
 

OFFICIAL RULES FOR CONTEST

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

Please read these rules before entering the Batteroo Customer Appreciation Contest (the “Contest”). By submitting an entry, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Batteroo Inc. (“Sponsor”, “we”, “our” or “us”) and the judges, and that you satisfy all eligibility requirements.

ELIGIBILITY. Open to individuals who are 18 years of age or older than the legal age of majority in their jurisdiction of residence at the time of entry; The Contest and these Official Rules are void where prohibited by law, and are subject to applicable laws. Entrants may not be members of any guild, union or other organization that may prohibit them from participating in this Contest and that would restrict, require due payment or otherwise have the right to oppose such entrant’s participation in this Contest. This Contest is also not open to employees or independent contractors, or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) or those living in the same household of employees or independent contractors of any entity involved in any aspect of the Contest (including funding, judging or administration), and each of their respective parents, subsidiaries, affiliates, advisors, or advertising/promotion agencies.

HOW TO ENTER. Contest entry period for January begins on January 25, 2017 and ends at 11:59:59 p.m. (PT) on February 28, 2016 (the “Entry Period”). To enter for the video contest, with the potential $500 reward, you must:

  1. Create a unique video or photo showing how you use Batteroo in your battery operated device. We want to see how you’ve benefited from Batteroo! 
  2. If you created a video, Upload the video to your youtube or vimeo account. If you created a photo upload the image to www.imgur.com  or a similar photo hosting site.
  3.  Go to the Contest entry page on the batteroo.com website and submit your contact information and link to your unique video. If you created a photo, submit the photo link.

The Video or photo and completed entry form and required information are collectively referred to as the “Entry”. All Entries must be received by 11:59:59 p.m. (PT) on Jan 31, 2017.

You may also enter for a prize of ($50), by submitting a customer testimonials. 10 winners will be selected for each entry period. To enter:

1)    Write a unique testimonial describing how you used Batteroo in your battery operated device and how you benefited

2)    Go to the Contest entry page on the batteroo.com website and submit your contact information along with your testimonial

 

ENTRY REQUIREMENTS. Each Video, photo or testimonial must: (a) be the original creation of entrant; and (b) be suitable for and meet reasonable community standards.

Limit one (1) Entry per person. In the event any entrant submits more than one (1) Entry, the first Entry received by Sponsor will be deemed that entrant’s Entry. Sponsor reserves the right in its sole and unfettered discretion to disqualify at any time any Entry containing obscene, offensive, pornographic or sexually explicit material, or libelous, disparaging or other inappropriate content or subject matter (as determined by Sponsor in its sole discretion). Sponsor’s (or its contractor’s) servers and clock will be deemed the official clock for the Contest, and entrant’s proof of Entry submission does not constitute proof of receipt by Sponsor. Entrants who submit their Entries using a wireless device may be charged according to their rate plans with their wireless carriers.

CONDITIONS OF ENTRY. All Entries must be the original creations of the entrants, and by submitting an Entry, each entrant grants to Sponsor the non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the Video throughout the world in any media, to the extent permitted by applicable law.

By submitting an Entry, each entrant represents and warrants that (a) his/her video or photo or testimonial is his/her original creation; (b) his/her video or photo or testimonial has not been copied or derived in whole or in part from any other work; (c) his/her video or photo or testimonial (including all footage and people depicted in the video or photo) does not violate or infringe any copyright, trademark, privacy or publicity right, or other personal, proprietary, or intellectual property right of any person or entity; (d) his/her Video or photo or tesimonial is not defamatory, libelous, obscene, or otherwise illegal; (e) his/her Video or photo is the sole and exclusive property of the entrant; and (f) he/she has complete, worldwide distribution rights for his/her Video or photo. By submitting a Video or photo, such entrant consents, by virtue of submitting his/her Entry to the Contest, to Sponsor’s use of the entrant’s name, likeness, video or photograph or image, whether in writing, audio, and/or video or photo, for any purpose, in any media, without compensation or additional consideration to entrant. Failure to obtain or provide such consent will disqualify the Entry. Sponsor may at any time during the Contest request proof of such consent and disqualify any Entry for which such consent cannot be provided. Sponsor may disqualify any entrant whose Entry Sponsor determines, in its sole discretion, at any time does not comply with any requirement described in these Official Rules or the foregoing representations and warranties.

Entrants agree to indemnify and hold harmless Batteroo, any entity involved in any aspect of the Contest (including funding, judging or administration), advertising agencies, contractors, and each of their respective parents, subsidiaries, affiliates, advisors, and advertising/promotion agencies (collectively, the “Released Parties”), for any action or claim brought by a person whose consent entrant did not obtain. To the extent permitted by applicable law, Entries, along with the entrant’s name may be posted on www.batteroo.com or any its social media pages, such as Facebook, Twitter or Instagram, and any other web site or other online point of presence on any platform, through which any products or services available on or through the Sponsor Site are described, syndicated, offered, merchandised or advertised, in Sponsor’s sole discretion. Sponsor’s decision to post an Entry or any portion of an Entry on any Sponsor Site does not mean that the selected Entry has been selected as the winning Entry.

By participating in this Contest, entrants are authorizing the transfer of personal data to the United States for purposes of administering the Contest, conducting publicity about the Contest and such additional purposes consistent with our goals or the Contest goals. By entering the Contest, entrants consent to our collection, use and disclosure of their personal information for these purposes

Sponsor is collecting personal information primarily to process the Entries and to contact you if necessary.

JUDGING. Each qualified Video or photo Entry will be judged and rated by a panel of qualified judges selected by Sponsor using the following criteria: (a) amount of creativity demonstrated in the video or photo (35%); (b) quality and composition of the video or photo (35%); and (c) how well the video or photo demonstrates the benefit that Batteroo provide (30%) (collectively, the “Judging Criteria”). One Grand Prize winner will be selected at the end of each month based on the Judging Criteria. In the event of a tie, the tie will be broken by the tied Entries being judged and rated based solely on the “amount of creativity demonstrated in the video or photo” criteria.

Each qualified Testimonial Entry will be judged and rated by a panel of qualified judges selected by Sponsor using the following criteria: (a) creativity of content (35%); (b) clarity and organization (30%); and (c) how well the testimonial demonstrates the benefit that Batteroo provide (35%) (collectively, the “Judging Criteria”). Ten winners will be selected at the end of each month based on the Judging Criteria. In the event of a tie, the tie will be broken by the tied Entries being judged and rated based solely on the “amount of creativity demonstrated in the video or photo” criteria.

In the event the potential winner’s Entry is disqualified, the entrant who submitted the next highest rated Entry in the applicable jurisdiction will be the potential Grand Prize winner, and must comply with the requirements in these Official Rules. All decisions of the judges are final and binding.

PRIZES.

One (1) Prize winner will receive $500 USD for their video or photo submission.

Ten (1) prize winners will receive $50 for their testimonial submissions.

CONDITIONS OF PARTICIPATION. On or about  February 6, 2017, Sponsor will notify the potential Prize winners of the January contest via   e-mail and the potential Grand Prize winner may be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release as requested by Sponsor. Prior to awarding a prize, Sponsor may, in its sole discretion, require the potential winners to sign such additional documents Sponsor decides are necessary to confirm eligibility, to obtain a liability/publicity release, and to award any prize. Failure to return any required document by the date requested by Sponsor will deem the winner as ineligible to receive the prize. If any documentation is not returned by the specified dates or if a potential winner is deemed ineligible prior to the prize being awarded, Sponsor may, in its sole discretion, award the prize to the entrant receiving the next-highest score in the applicable jurisdiction. Contest winners for February will be notified on or around March 6.

Furthermore, winners will be required to sign and return a “Transfer of Copyright” form as requested by Sponsor. Winners hereby acknowledges and understands that under such Transfer of Copyright form, he/she will be assigning exclusively, irrevocably, and in perpetuity, and on a royalty-free basis to Sponsor (or to Sponsor’s affiliates) all copyright ownership and all other proprietary rights in and to his/her Video or photo, such that Sponsor (and its affiliates) will have the unrestricted right to edit the Video or photo in any manner and to use (or not use) the Video or photo for any and all purposes whatsoever (including, without limitation, the creation of derivative works, and/or any and all other forms of commercial or non-commercial exploitation), regardless of whether or not related to the Contest.

ADDITIONAL TERMS. To the maximum extent permitted by law, Sponsor reserves the right, in its sole discretion, to change these rules or cancel the Contest at any time, or to modify, terminate, or suspend the Contest should viruses, worms, bugs, unauthorized human intervention, or other causes beyond Sponsor’s control corrupt or impair the administration, security, fairness, or proper play of the Contest or submission of Entries, or in the event Sponsor does not receive a minimum of 20 qualified Entries from separate eligible entrants. Sponsor is not responsible for any human or other error that may occur in the processing of the Entries or Video or photos, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to, or alteration of, Entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any web site. Sponsor is not responsible for injury or damage to any entrant’s or any other computer resulting from downloading any materials in connection with the Contest. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process, the outcome of the Contest, or the operation of the Contest or Web site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AFFILIATES RESERVE THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

MISCELLANEOUS.   By entering, entrants agree to be bound by these rules. No transfer, assignment, cash redemption or substitution of prize is permitted except by Sponsor due to prize availability and then with a prize of equal or greater value. Entrants agree (for themselves and their heirs) that the Released Parties will have no liability, and will be held harmless by such entrants to the maximum extent permitted by law for any liability, loss, injury, or damage to property or to person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of participation in the Contest, or by reason of the acceptance, possession, use or misuse of the prize, even if caused or contributed to by the negligence of any of the Released Parties. Contest is governed by the laws of the United States and the State of Washington. As a condition of participating in this Contest, entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will entrants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental or consequential damages, including attorneys' fees, other than entrant’s actual out-of-pocket expenses (e.g. costs associated with entering), and entrant further waives all rights to have damages multiplied or increased. Contest is void where prohibited by law. Entrants agree that the decisions of Sponsor and the judges related to the Contest are final. By participating in the Contest, entrants consent to the use of their names, biographical information, Entries, images and/or likenesses in any manner and in any medium for any purpose in connection with the Contest, including worldwide, without additional compensation, except where prohibited by law.

 

Batteroo.com Ecommerce Return Policy:

  • We do accept returns and provide replacements if you receive a defective product.
    • We work diligently with our product team and manufacturers to create high quality products but we understand that sometimes there are errors in the manufacturing process that may result in defects. In these cases, we are happy to replace defective products with brand new fully functional sleeves.
    • Customers requesting a replacement for a defective product should send us an e-mail with their full name and order number to support@batteroo.com . In order to better assist you, please describe the defect and provide at least one photo of the sleeve showing where the defect appears.
    • If it appears to be a genuine defect, we will provide you with an RMA number so that you can ship the defective product back to us for inspection. 
    • Please send the sleeves back in the original plastic casing before packaging. Then ship the product back to us with an RMA number on the packaging, to :

    • Customer must pay the return shipping cost for the package.
    • We will promptly investigate and inspect the sleeves for defects and then send you back a new replacement order if the sleeves are defective (same number and size of sleeves). Batteroo will cover the cost for shipping the new replacement product.
    • The time limit for replacement requests is 30 days, so please make your replacement request for defects within 30 days after receiving your order.   
  • No refunds. While we are happy to give new replacements for defective products, we do not give refunds. 
  • No returns because Batteroo doesn’t fit in a specific device: We understand that Batteroo Boost will not fit in all of your devices, but we do not accept returns in cases where a customer expresses that there wasn’t enough room for the Batteroo Boost to fit inside a specific device. Don’t worry, for every device where the Batteroo Boost does not fit, there will be many others where it will fit perfectly fine.
